Earlier this month I mentioned to you that the Federal Trade Commission had busted a spam ring which sent pornography spam from their hidey-hole in Las Vegas.

This particular FTC action was of note because it was the first which was publicly noted to include charges under the McCain Amendment to CAN-SPAM, on which I worked, and which I like to refer to as the “vendor liability” section, although others call it the “advertiser accountability” section. It boils down to the same thing, as FTC Commissioner Eileen Harrington says: “It’s not just people who push the button to send the spam who can be held liable.”

It’s also the people who are being advertised in the spam, and they are often much easier to find.

The Vegas porn spam was also taken down for not adhering to the plain brown wrapper rule, which says that email which is of an “adult� nature must be clearly marked in the subject line as such, among other things.

Aunty would also like to tell you about another sort of Vegas entertainment which also involves the absence of a wrapper, only this one, while only slightly more wholesome, is a lot more legal, and a lot more gratifying.
