Our courts have been known to do some goofy things (such as aquitting O.J. and Robert Blake). Although it is not good that the "evidence" of an encryption program was allowed to stand, I don't foresee this as setting a precident. Please note that I have no leagal training. I just believe that if the attorney for the defense would put on the stand several respectable local individuals or businessmen who will testify that they use the identical program, it will not only weaken the case against the defendant but reduce chances that the same ploy will be used as evidence in future cases.
